Open Question: Can my mortgage company take my tax refund if i am in foreclosure?

We are in "accellerated" foreclosure. We haven't received the notice of sale, but the company refuses to accept any payment from us unless it is the full arrears. Yet, they took our federal tax refund and i was told that legally since we are in foreclosure, they have to return the refund. Is that right? more…

My neighbors were busted about 8 weeks ago for cultivating over 236 marijuana plants. They moved out, but now it looks like they might be moving back in. At least until the Sheriffs Department comes to change the locks! Here is my California foreclosure question- when does someone actually enter into foreclosure? If these people make a payment one month, but not for 3 months and then make another payment and then skip again at what point will foreclosure kick in? It seems like an odd question. I know. I thought a person had to not make any payments for 120 days and then the home goes into foreclosure. But when I add a twist of making a payment here and there at what point does a foreclosure catch up? (Unless, of course they come up with all the cash in which case I know they can keep their home.) I am currently in the process of purchasing a Condo in the South San Diego area and I've been shown a lot of property that is "Short Selling". I was wondering if it is worth the time to go forward in trying to purchase a property that is "short selling". I've been told that more than likely I will only be disappointed since there is a good chance the bank will not accept offers even at the listed prices. Also, that the bank tends to increase the price of the property when then causes potentially buyers to drop out ultimately causing the property to go into foreclosure at even a smaller amount then what was being offered. I just want people's inputs especially people who have purchased or tried purchasing property that was a "short sell". Thanks everybody. more…

ok, my house went to foreclosure (investment property), the bank bought it back at the sale. I guess they are trying to get some money out of it. The problem is the second mortgage company, they want their money, with everything i know about the mortgage industry, I do know that the 1st is always the one that comes first. As far as i know the 1st mortgage is going to list the home for sale so they don't loose out, and i know the state of maryland requires the 1st to notify anyone else that is listed on title before a court appointed sale. I'm not sure what to do, the collection agency is calling me asking me for money I don't have, they keep saying they are willing to make a deal. What are my rights, the property was in Maryland and I currently live in NJ. NJ has very strict Judgement laws, the last thing I need is a wage garnishment on what little money i make right now. I bought a house (Mandarin Lakes) in Homestead May 06, i stopped paying in Dec 06 i bought it for $250k now the builder is selling for $190k, i'm going to foreclosure, everyone is around the area, i don't want the house it's too dangerous i don' t care about my credit what i care is that i have a property in Tx, i have payments on my car and i have a 2nd equity loan on my parents house which i have a quick claim deed. I owned a home in 2007, lost it in Feb 07, i filed a deed in lieu of foreclosure. But tech a foreclosure that i am learning now. Me and my ex fiance both rcvd the 1099A and 1099C, i need to know what we can do or what steps we need to take to file, either long form or through turbo tax. he made less then 12000.00 for the year and i made ovr 40k. keying into turbo tax i owe over 10k and he owes 6-7K. then found out about the 982 form. is there a way that i/we can qualify for it? do we both need to file all these forms? why did we get both? im panicking, how can i pay something like this when i was not able to pay my mortgage?? does irs take min payments? do they charge interest? help me please thank you in advance for anyone able to help me!!! more…

my friend is renting the house that now is in foreclosure, my question is if the bank come to the house do they take away the all the things that are from the people are renting? or they put their stuff in the street? all this is after he has the letter from the bank. thanks more…
